1. Acceptance
By accessing the website or using SimpleQualify, you agree to these terms and any applicable order form, service agreement, documentation, or policy incorporated by reference. If you are using the service for a company, you represent that you have authority to bind that company.
2. Service description
SimpleQualify provides tools for submitting authorized pre-qualification requests, receiving available financial qualification information, and delivering results to a customer's selected workflow or return destination.
SimpleQualify does not provide legal, tax, investment, credit-repair, lending, or underwriting advice. A qualification result is not a guarantee of approval, suitability, financing, conversion, or any particular customer outcome.
3. Customer responsibilities
You are responsible for:
- Obtaining all notices, consents, authorizations, and instructions required for each request.
- Submitting accurate information and using the service only for lawful, authorized purposes.
- Maintaining the security of credentials, API keys, webhook destinations, and user access.
- Configuring your qualification logic, CRM fields, routing, sales process, and downstream decisions.
- Complying with applicable consumer protection, privacy, marketing, credit, and industry rules.
4. Prohibited use
You may not use the service to:
- Submit a request without the required authorization or permissible purpose.
- Access, test, scan, disrupt, reverse engineer, or misuse the service or another customer's data.
- Transmit malicious code or use the service for fraud, deception, discrimination, or unlawful activity.
- Resell access or disclose credentials unless expressly permitted in writing.
- Represent a pre-qualification result as a guaranteed approval or binding credit offer.
5. Fees and billing
Fees are stated in the applicable order form or account configuration. Usage-based charges may apply to submitted or completed qualification requests according to the agreed billing rules. You authorize applicable charges using the payment method associated with your account.
6. Customer data
As between the parties, you retain your rights in data you submit. You grant SimpleQualify the rights reasonably necessary to process the data, complete authorized requests, deliver results, secure the service, and meet contractual and legal obligations.
7. Availability and changes
We may improve, modify, suspend, or discontinue features. Service availability can depend on third-party systems, data availability, matching, credit freezes, technical conditions, and other factors outside our control.
8. Confidentiality
Each party may receive nonpublic business, technical, or commercial information from the other. The receiving party will use reasonable care to protect confidential information and use it only for the applicable business relationship, subject to customary exclusions and legal requirements.
9. Disclaimers
Except as expressly stated in a written agreement, the website and service are provided on an "as available" basis. To the maximum extent permitted by law, SimpleQualify disclaims implied warranties, including merchantability, fitness for a particular purpose, and noninfringement.
10. Limitation of liability
To the maximum extent permitted by law, SimpleQualify will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost revenue, profits, data, goodwill, or business opportunities. Any additional liability limits will be governed by the applicable written agreement.
11. Suspension and termination
We may suspend or terminate access for nonpayment, security risk, unlawful activity, violation of these terms, or conduct that threatens the service, its providers, consumers, or other customers.
12. Changes to these terms
We may update these terms from time to time. Continued use after an update becomes effective constitutes acceptance of the updated terms, unless a separate agreement provides otherwise.
